Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of portconnect.in (the "Platform"), operated by PortConnect ("we," "us," "our"), based in Vizhinjam, Thiruvananthapuram, Kerala, India. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. What PortConnect is

PortConnect is a business directory listing businesses operating in and around Vizhinjam International Seaport, across categories such as ship agency, logistics and freight, marine services, and others. PortConnect is a discovery and contact platform only — we are not a party to any transaction, contract, or agreement between a listed business and anyone who contacts them through the Platform. We do not guarantee the quality, safety, legality, or availability of any service offered by a listed business.

2. Eligibility and accounts

• You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to create an account or list a business.
• You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when registering or submitting a business listing, and to keep it updated.
• We reserve the right to suspend or terminate any account that provides false information, violates these Terms, or is used for fraudulent or abusive purposes.

3. Business listings

• Every listing submitted is reviewed before publication. We may approve, reject, edit for clarity, or request changes to a listing at our sole discretion, and we are not obligated to explain a rejection.
• You confirm that you have the right to list the business and that the information provided (contact details, services, description, images) is accurate and not misleading.
• You may not list a business you do not own, operate, or have explicit authorisation to represent.
• We reserve the right to remove any listing at any time, with or without notice, if it is found to be inaccurate, fraudulent, inactive, in violation of these Terms, or otherwise inappropriate.

4. Plans and payment

• The Starter plan is free, with no expiry, and does not require payment information.
• The Verified plan is a paid annual subscription. Fees are quoted in Indian Rupees and are exclusive of any applicable taxes unless stated otherwise.
• Custom plans for multi-branch or large businesses are priced individually and agreed separately in writing or via email before activation.
• Paid plans renew annually unless cancelled before the renewal date. You can cancel a paid plan at any time; your listing will revert to the Starter plan at the end of the current billing period.
• Fees already paid are non-refundable except where required by law, or where we are unable to deliver the paid features due to a fault on our part.

5. Enquiries and communications

When you submit an enquiry through a listing or the contact form, your details and message are shared directly with the relevant business (or with PortConnect, for general enquiries) so they can respond to you. PortConnect is not responsible for how a business handles, stores, or responds to an enquiry once it has been delivered to them.

6. Acceptable use

You agree not to:

• Submit false, misleading, defamatory, or fraudulent information in any listing, enquiry, or account.
• Use the Platform to send unsolicited commercial messages (spam) to businesses or users.
• Attempt to gain unauthorised access to any account, listing, or part of the Platform's systems.
• Scrape, copy, or republish directory data in bulk without our written permission.
• Use the Platform for any unlawful purpose or in violation of any applicable Indian law.

7. Intellectual property

The PortConnect name, logo, website design, and underlying software are the property of PortConnect and may not be copied, reproduced, or used without our written permission. Content you submit for your listing (descriptions, photos, logos) remains your property, but by submitting it you grant PortConnect a non-exclusive, royalty-free licence to display it on the Platform for as long as your listing remains active.

8. Disclaimers

The Platform and all listings are provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure. We make no representation or warranty regarding the accuracy, completeness, or reliability of any business listing, and we do not endorse any listed business. Any dealings between you and a business found through PortConnect are strictly between you and that business.

9. Limitation of liability

To the maximum extent permitted by law, PortConnect shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Platform or any transaction, dispute, or communication with a business listed on it. Our total liability for any claim arising out of these Terms or your use of the Platform shall not exceed the amount, if any, paid by you to PortConnect in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold PortConnect harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your listing content, your use of the Platform, or your violation of these Terms.

11. Termination

We may suspend or terminate your account or listing at any time, with or without cause, and with or without notice, particularly in cases of suspected fraud, abuse, or violation of these Terms. You may close your account at any time by contacting us.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Thiruvananthapuram, Kerala.

13. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date above will reflect the most recent version. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
